Insurers file Writ as precautionary
measure
Vernon, BC - A Writ has been filed in the BC Supreme
Court naming Tolko and others as plaintiffs, and the City of Kamloops,
the Thompson-Nicola Regional District and others as defendants,
as a result of the loss of property and damage that occurred during
the McLure-Barriere forest fire in August 2003. The Writ claims,
in part, that, “the fire, the rapid spread of the fire and
the resulting loss and damage to the plantiff(s) were as a result
of the negligence and breach of statutory duty on the part of the
defendants.”
This Writ was not filed by Tolko. It was filed by the insurers
as a precautionary measure to protect their rights of subrogration
against a third party for the damages that resulted from the wildfire.
The law firm hired by the insurers had asked for an extension of
the six month time limit for filing suit against a municipality.
This request was denied so the insurers proceeded to file the Writ
as a precautionary measure.
Further investigation is ongoing and the suit may or may not proceed.
